These terms and conditions outline the rules and regulations for the use of Mish V Photography's Website, located at https://mishvphotography.co.uk.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Mish V Photography if you do not agree to take all of the terms and conditions stated on this page.

Terms and Conditions for Newborn Photography

1. Introduction

These terms and conditions constitute a legally binding agreement between Mish V Photography and the client. By booking a newborn photography session, the Client agrees to the following terms and conditions.

2. Booking and Payment

2.1 A refundable deposit of £25 is required to secure the booking. The remaining balance is due on the day of the session.

2.2 Sessions are booked on a first-come, first-served basis. Your booking is confirmed only upon receipt of the deposit.

3. Rescheduling and Cancellations

3.1 Rescheduling requests must be made at least 48 hours before the scheduled session. The Photographer will attempt to accommodate one rescheduling without an additional fee, subject to availability.

3.2 If the Client cancels the session, the deposit will not be refunded. In the event the Photographer cancels, a full refund of the deposit will be provided or an alternative date offered.

4. Session Arrangements

4.1 The Photographer will provide a pre-session consultation to discuss the Client's preferences and expectations.

4.2 The session will take place at the Photographer's home studio or an agreed-upon location.

4.3 It is the Client’s responsibility to ensure the newborn is fed and comfortable prior to the session.

4.4 If the Client is more than 30 minutes late for a session without communication, the session will be cancelled, and no refund will be given. Being late will result in cutting down the time from the duration of the shoot and may result in fewer images taken. It is the Client’s responsibility to be on time for the shoot.

4.5 Your Baby’s Safety

Ensuring your baby’s safety is paramount. During every session, I collaborate closely with parents to ensure your newborn's comfort and security. Parents are always asked to stay right next to the baby and explain how to quickly hold the baby in place safely if they wiggle. I never push boundaries or compromise safety to achieve a specific shot. Instead, I work within your baby's natural rhythms and preferences, capturing authentic moments that reflect their true essence.

5. Artistic Rights

5.1 The Photographer retains the right to exercise their professional judgment regarding the style and artistic composition of photographs.

5.2 The Client understands and agrees that the final photographs will reflect the Photographer's style and vision.

5.3 Mish V Photography shall be entitled to use its judgment regarding the style and artistic input in the production of pictures. This includes but is not limited to locations, poses, and the number of images taken. Due to the vagaries of weather and the willingness of subjects, it may not be possible to capture all the pictures requested or images to the Client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Mish V Photography may not be able to capture any or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.

6. Image Delivery

6.1 Edited images will be delivered to the Client within 4 weeks of the session.

6.2 The Client will receive 5-25 high-resolution digital images depending on the package chosen. Additional images or prints can be purchased as per the Photographer’s pricing guide.

6.3 Clients receive high-resolution edited JPG images. Raw files are never provided to the Client.

6.4 Mish V Photography fully edits all images before presenting them to the Client. Additional edits are carried out at the discretion of Mish V Photography, and Mish V Photography reserves the right to charge the Client for additional editing to cover the time involved, at a rate of £15 per image. Any additional edit requests MUST be raised by the Client at the proofing stage. Requests not raised at the proofing stage will not be considered once products have been ordered.

6.5 Preview images are chosen at the discretion of Mish V Photography. Although Mish V Photography will do its best to produce more proofs than discussed with the Client, there is no guarantee that any particular number of proofs will be produced.

6.6 If the Client does not view or purchase images within one month of the session without arrangement, Mish V Photography will assume they are not wanted and will delete all files.

6.7 Online galleries will be live for 72 hours. All orders must be decided during this time. If more time is needed, the Client must speak to the Photographer. The first reopening of online galleries will incur an admin charge of £25.

6.8 All images produced by Mish V Photography are created on a fully calibrated monitor, ensuring that the prints are a true reflection of the editing carried out. Mish V Photography will not be held responsible for variances in images caused by clients viewing images on non-calibrated screens or monitors.

7. Copyright and Reproduction

7.1 The Photographer retains all copyright and ownership of the images.

7.2 The Client is granted a license for personal use of the images. This includes printing for personal use and sharing on social media with proper credit to the Photographer.

7.3 Commercial use of the images is prohibited without prior written consent from the Photographer.

7.4 Mish V Photography retains the right in all cases to use the pictures in any manner at any time throughout the world for the purposes of sales, advertising, or promotion of its work.

7.5 If the Client loses or damages their digital images, Mish V Photography will not be liable for such loss or damage and will not replace lost or damaged files. It is highly recommended that Clients immediately back up any digital files on an external drive or via online cloud storage. Digital images purchased by the Client remain the property of Mish V Photography and may not be altered in any way, shape, or form. This includes but is not limited to editing the overall style of the image, making color/contrast/exposure changes, cropping portions of the images, adding objects/persons/graphics, or deleting objects/persons/graphics.

7.6 It is illegal to download or attempt to remove a watermark from any image taken and posted online by Mish V Photography for any reason. Should an image be saved via any means and used elsewhere without the written permission of Mish V Photography, whether the copyright has been removed or not, a copyright infringement fee of £1000 per image will be applied to avoid court action and must be paid within 28 days.

8. Model Release

8.1 The Client grants the Photographer permission to use images from the session for promotional purposes, including website, portfolio, social media, and marketing materials.

8.2 If the Client does not wish for the images to be used for promotional purposes, a written request must be submitted at the time of booking with an option to purchase the full copyright of the images by paying £75.

9. Liability

9.1 The Photographer will take the utmost care in handling the newborn and capturing the photographs. However, the Photographer cannot be held liable for any unforeseen incidents or injuries that may occur during the session.

9.2 The Photographer is not responsible for any damage or loss of digital files beyond their control.

9.3 While Mish V Photography has taken reasonable care to correctly identify, caption, and orientate the pictures, it does not accept any liability for loss or damage incurred by the Client or any third party caused by any errors.

10. Cake Smash Sessions

10.1 It is the responsibility of the Client to inform the Photographer of any allergies upon booking. The Photographer will not be held liable if a child is found to be allergic to any of the ingredients used to make the cake.

10.2 The Photographer has the cakes professionally made by a third party. Items may contain or have come in contact with nuts.

10.3 By agreeing to these terms, the Client waives all rights to sue Mish V Photography if any illness results due to lack of information given to Mish V Photography by the Client.

11. Privacy Policy

Mish V Photography will never share, allow access to, or distribute any personal or contact information of any client or inquiry obtained by any means. ALL contact information is protected on secure systems. For the full privacy policy statement, see [link to privacy policy].

12. Miscellaneous

12.1 This agreement constitutes the entire understanding between the Photographer and the Client.

12.2 Any amendments to this agreement must be made in writing and signed by both parties.

12.3 All prices are subject to change without notice by Mish V Photography. No consideration will be given to previous clients regarding product pricing, availability, package structure, or session fees.

12.4 RETURNS POLICY

Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client.

Faulty items should be returned to Mish V Photography. The Client is responsible for any costs associated with return postage.

Returns will not be accepted for incorrectly ordered items or items ordered in error. No return, exchange, or refund is available for any item once the image proof has been approved and an order has been placed.

13. Gift Vouchers

13.1 Gift vouchers purchased from Mish V Photography are valid for 12 months from the date of purchase.

13.2 Gift vouchers cannot be exchanged for cash and are non-transferable. No refunds will be given.

14. Image Retention

14.1 Images are kept for a six-month period at the discretion of Mish V Photography.

By booking a newborn photography session with Mish V Photography, the Client agrees to these terms and conditions.
